The National Credit Act (NCA) introduced Debt counseling to South Africans in 2007. Debt counseling is the process that helps over-indebted consumers get out of debt.

What costs are involved with being placed under Debt Review?
The National Credit Regulator (NCR) regulates the fees a debt counsellor can charge. The charge is dependent on your monthly installment amount. Before you agree to being placed under debt review your debt counselor will advise you of the fees. You can ask your Esscor counselor what the fees are but be assured it is minimal as we are here to help you get out of debt. Once you have been placed under debt review the fee payable to us is included in your debt repayment plan.
How to check if your name is under debt review?
You must be placed under debt review by a registered debt counselor. Only debt counselors registered with the National Credit Regulator (NCR) can place you under debt review.

You can request a credit report once a year for free from any South African credit bureaus, eg, TransUnion, etc. You can call any credit bureau dispute center; it will be marked on the front page of your report if you are under debt review.
I have completed the debt review process:
The good news that you have completed the debt review process is a job well done. Your debt counselor / Esscor will notify you that you have completed the debt counseling process & you are therefore no longer under debt review. 21 working / business days after you have been notified the credit bureaus are legally obligated to remove the “under debt review” flag from your credit profile. You can obtain a clearance certificate.
Can I apply for credit after completing debt review?
You can apply for credit after completing the debt review process. Your credit report will allow you to check whether the bureaus have removed the ‘under debt review’ flag from your profile. Your under-review status should not affect your new application, but should your credit application be denied or rejected, you can draw a copy of your credit report to find the reason or request a reason from creditor.
I have NOT completed the debt review process, what happens now?
If you do not complete the debt review process you will remain “under debt review” The National Credit Regulator (NCR), will not allow you to remove your name from debt review if you have a court order in place without making an application to exit the process. Only once you complete the debt review process by paying all your debt then will you be cleared from the “under debt review” status.
Does debt review affect my insurance policies?
No, insurance is included in your debt review process. Your insurance forms part of your expenses that will be under review.
If I am in an accident or an occurrence beyond my control what happens if I cannot pay my monthly debt review installment?
You will need to prove that you were unable to pay your instalment. If e.g. you were involved in an accident & could not pay your instalment due to being hospitalised, the debt counselor can notify your creditors. If it is within reason that you were unable to make the payment it is very likely that you can be excused for delaying payment. You will need to make arrangements to continue with your monthly instalment soonest.
Will the debt counselor contact my employer to notify my employer know that I am under debt review?
No. Esscor will not contact your employer.
If I am unemployed, can I apply for Debt Review?
No, if you are unemployed and do not earn any other income from another source you cannot be placed under debt review There are other solutions available that might be beneficial for you, so you can still contact us.
Can my Credit Providers still contact me once I am placed under debt review?
By law, your credit providers must communicate with your debt counselor. Once you apply for debt review, Esscor will contact all your credit providers to inform them that you are under debt review. Within 5 days from being placed under debt review all your credit providers must communicate with your debt counselor. Should any of your credit providers still contact you, you should refer them to Esscor. We will deal with them.
How do you (Esscor) lower my monthly payments?
The debt review process allows Esscor, your debt counselor, to reduce your monthly instalments by adjusting your repayment period & where possible reducing your interest rates. We have to comply with the National Credit Act (NCA) but Esscor will try their utmost to reduce your monthly instalments to make your payment plan acceptable.
Do I need to visit your office to apply for debt review?
No, you do not. We will call you & the full process can be completed telephonically & by email. You are more than welcome to visit our office anytime, but everything can be done electronically.
If I get retrenched while I’m under Debt Review, what happens?
You will need to contact Esscor as soon as you are notified that you are being retrenched. The conditions to be places under debt review is that you can pay your monthly installments. If you are unable to make the payments, we will try to find another solution for you. We will do our best to help you during this time.
Can I use my credit cards or store cards while I am under Debt Review?
No, you cannot.
Can I apply for more credit while I am under Debt Review?
No, you will not be able to apply for any more credit until you have been issued with a clearance certificate once you have completed your debt review process.
What if I already have judgements against me?
We can evaluate your situation & try to find a solution for you. If we cannot provide you with debt counseling, we can provide you with another solution. Contact Esscor & speak to one of our counselors.
I have been summoned to court; can a debt counsellor help me?
If we are able to assist you, we will do so but we will need more information to evaluate your case.
How does debt counseling influence my credit record?
During the Debt review period your credit record will be flagged “under debt review” Your creditors or anyone drawing a credit report on you will be able to see that you are under debt review. Once you have completed the debt review process & fulfilled all your obligations the flag will be removed.
Can I be “blacklisted” by Credit Providers while I am under Debt Review?
No, you cannot. Once you are placed under debt review none of your creditors can blacklist you. If you are already blacklisted before going under debt review your credit report will state that you are blacklisted.
At any point in the debt review process, do I need to appear in court?
Esscor handles all the court proceedings, Esscor will be the applicant & you will be the respondent. Esscor appointed attorneys will inform us & we in turn inform you of the application outcome. You will not have to appear in court unless in the rare instance that the magistrate requests your presence.
How long will I remain under Debt Review?
How long you remain under debt review depends on how long your instalment period is extended to. We try to lower your monthly instalment to an amount that is conducive to your financial situation. The debt review process period will be provided to you by Esscor debt counsellors.
Can I lose my house or vehicle when I am placed under Debt Review?
Yes & no. If you are struggling to keep up with your payments, contact Esscor to be placed under debt review before you are served with summons or letters from your credit providers. There are certain instances where you can lose your house / vehicles if you surpass a certain threshold placed by your credit providers. If you are not certain of how over indebted, you are call Esscor to establish where you stand & how we can help you.
When will I be able to feel DEBT relief?
Almost immediately. During the 1st 60 working days none of your credit providers will be able to take any action against you. Your debt will be consolidated into 1 affordable monthly installment. Your debt counselor will calculate the monthly installment amount for you & once all the paperwork has been finalized you will pay only that installment.

Debt Counselling was formally introduced by the National Credit Act to help over-indebted consumers, especially in our current economic crisis. The goal of Debt Counselling is to develop a repayment plan which is affordable to you, as well as acceptable to all your credit providers. It is there to help you, so why not make use of it?
